can someone tell me how this makes sense?

how can a rertired judge make a decision on anything?

First off, I hope she rests in peace and Texas puts this guy on the express lane to a needle.


It seems that part of the story was concerning the trial he had in November of last year. I believe, if I am reading this right, the judge granted the request when he was in charge of that case and then later retired. I think they are just mentioning he is now retired.
