Police Involved Incident Under Investigation


On June 16, 2010, at approximately 10 p.m., Dallas Police Officer Kelly Beemer #9303, while off-duty, became intoxicated in a public place in the City of Dallas. Another off-duty officer at the location attempted to assist Officer Beemer by driving her home. Officer Beemer exited the assisting officer’s personal vehicle and attempted to hide. On-duty officers Miguel Jamaica #7175 and Zachary Helm #8859 responded to the scene to help take control of Officer Beemer. Officer Beemer was placed in the back seat of Officer Helm’s vehicle. Officer Jamaica returned to end his tour of duty. Officer Helm requested officer Steve Meyers #8730, who had just gotten off work, to meet and follow him to officer Beemer’s home and attend to her due to her intoxication.


As Officer Helm approached the intersection of Gaston Ave. and Abrams Road, Officer Beemer retrieved a revolver from her ankle holster and fired one shot into the right rear floorboard of the vehicle. Officer Helm stopped the vehicle and he and Officer Meyers disarmed Officer Beemer. At this time a supervisor was called to the location and a command staff notification was made to the Duty Commander.


As a result of her actions, and after consultation with the District Attorney’s Office, Officer Beemer will be charged with Discharge of Firearm in Certain Municipalities, a Class A misdemeanor which carries a maximum penalty of one year in jail and/or a fine not to exceed $4,000. Officer Beemer has been placed on administrative leave pending the results of an internal investigation. Officers Jamaica and Helm have been placed on restricted duty during the investigation into their actions in this incident. A complete investigation of the events surrounding this incident and any officers involved is being conducted by the Police Department’s Internal Affairs Division. Should any additional allegations of misconduct be exposed they will be thoroughly investigated as well.


Chief David O. Brown is issuing the following statement. “I am extremely disappointed by Officer Beemer’s conduct and the actions she took during this incident. The recklessness she displayed is unacceptable conduct for a Dallas Police Officer and will be dealt with in a manner consistent with the Police Department’s disciplinary process. I believe some of the involved officers were making what they believed to be a good faith effort to assist a fellow officer. However, they could have clearly determined that officer Beemer was intoxicated to the point she was a danger to herself and the public and made an arrest during their initial contact with her. The officers were trying to do the right thing but did it in the wrong way.”

Guns and Booz don't mix, whether you are a LEO or have a concealed carry permit.


When you are armed, don't drink!


And if it is friends or fellow officers who may be intoxicated while armed, have them surrender their weapons. (You know they carry a back-up off duty.)


I have seen the news before in just about every major city. Glad only the vehicle received a GSW, and not an officer or bystander.

stupid yes, should she lose her job?, don't think so...since nothing bad came of it, thankfully, (although she could be billed for the vehicle repair) i think that the event in itself and the time following it is punishment enough. I am sure that there are some that disagree, and would throw the book at her, but if this is a first offense then let it go.


How are the assisting officers at fault for this? Yes they could have taken her revolver (if they knew about it i would think they would have done so), but they were just trying to help out a fellow officer that clearly made an error in judgement.

#2 Did no one pat this lady down before putting her in the car? Yeah, she's "one of their own" but my "armchair quaterbacking" says that a gun around the ankle should have never made it into the car.


#3 Drunk or not they should throw the book at her. That was extremely stupid and dangerous.
 
I don't think the Officers who tried to get her home, will get in trouble. They really didn't do anything wrong. Most departments will try and get anyone drunk home, without them driving. She didn't get any special treatment. I will not give a ride home to anyone who is so drunk they are unable to care for themselves, as that places you in a liability situation if they injury or kill themselves (aspiration of ones vomit, etc).


When the Officer fired her weapon, the show was over. The officers secured her weapon, contacted supervision, and did the right thing. Kudos to them for not getting caught up in a mess, that with a bad decision, could have eneded their careers!
 
The guys that were taking her home were doing her a favor like anywhere anyone else would have if she was in bad shape. It happens alot more than we know. Her actions put them in a bad place for doing her a solid favor. She was stupid and reckless and once she fired a wepon in that car she became dangerous. Those guys did the right thing and called the bosses.

I wouldn't have patted a fellow officer down to give them a ride either. That officer was desperate for her to drop that gun, he knew shooting her would be the worst thing of his life. She owes him everything for not killing her in the back of that car.
 
Helm and Beemer were dating. And it is said she had a boyfriend in Austin that drove up to post her bond.

Still, as someone previously mentioned, guns and booze don't mix. And, she was a puddle.
 
You know, listening to the video again I could hear the desperation in the officer's voice when he was forced to draw down on his own friend. That was probably one of the hardest things he'll ever have to do.
 
Talking at work this morning, one guy said she shot out the side window and emptied the revolver, as she's possibly heard saying "I'm out of bullets." Anyone else know this?
 
It may or may not be right. but she might just keep her job. It's says the offense is a misdemeanor, and it's hard to tell without reading the statute, but it isn't titled like a crime of violence. And she is by no means the first cop to get into off-duty trouble involving drinking and gunplay.


A month or two suspension without pay, no conceivable chance of promotion for the next decade, mandatory counseling and reassignment to Uniform Inventory or whatever passes for purgatory at that agency.

You're probably right. I know it's a different area, but if an LEO can get off with 6 mos unpaid for killing someone and still keep his job, this is small beans.

False.


You can hear the audio. One shot, in the floor board. Helm was recording the whole ride, and slammed the car to a stop and bailed right away. An ODO was following and ran up to help, one of them had her at gun point until they got the weapon away. The charge of discharging a firearm in the city limits is a class A, which in Texas, upon conviction, will revoke her peace officer license. Beemer is (was) a hard working Police. And she worked evenings in the area the bar is at. That bar is not a quiet hole in the wall, it gets a good number of calls. Why a Police would go drinking at a bar she works calls at, around people she might have hooked up, is beyond me. There is a chance that some jealous bar tender or waitress, or previous hook could have slipped something in her drink.

I listened to it again tonight. I thought I heard more than one shot as well and her say "I'm out of bullets."

In Texas if you are convicted of a Class A Misdemeanour or higher you loose your Peace Officer License. :eek:
