The rumour is that Whelen had to change the alpha Q tone to Mech tone since Fed Sig had a petent on the Q siren tone.
 
Your very correct on this, You can patent a sound, Harley Davidson did this with the sounds from their engines.

What one has to realize is that many of these items were manufactured and sold under a "patent pending" designation. For instance, the Federal model 17 designed by Earl Goswiller was first sold in 1948.
