State law still says only amber lighting, no siren. Some cities/counties really overlook, or even allow illegal equipment on the private funeral escorts, and security guard vehicles. The history of Texas and funeral escorts is kind of neat. For decades, until the early 2000's, the only LEO's allowed by State law, to have red/blue lights, and sirens on their POV's were Constables, and their deputies. This was because back then, Constables were completly county funded, with no state assistance. So most of the County Constables had to use their own vehicles. This was also before Constables were performing more common LE duties. They stayed focused on the civil process side, although they always had full Police powers. They were granted the ability to equip their POV's with emergency equipment in the early 70's, in order to get across the county in case of an emergency. Forward to the tie in with funeral escorts. Due to Constables being the only ones allowed to have EV equipment on their POV's, they started running escorts, off duty, for a fee, which allowed the municipal LEO's to stay on patrol. Some Constables and Deputies figured out that they could start their own business offering escorts. They would have constable, and a couple of civilians on motors, with the constable running red/blue and the civilians with amber. Then the civilians got smart, and started their own service. Eventually, the role of a Constable and their deputies became more infused with patrol LEO's, and the private escorts became more common. Now we have private escort civilians who ride motors with whatever equipment they can get away with, and violate the law every time. A private funeral escort still has no authority to run the red light and close an intersection, under state law, no legal authority to have red, blue, or clear lights, or sirens, and are not LEO's.
